The First 48 Hours of a Tenant Claim

Tenant claims are becoming more frequent and more costly, making a proactive response strategy more important than ever. During a recent CCIG webinar, one message stood out: it's often not the incident itself that drives litigation; it's how property managers respond in the hours that follow.

Colorado's evolving legal landscape has increased the importance of timely communication and documentation. Updates to the state's Warranty of Habitability law, combined with a rise in tenant-focused law firms, have contributed to more litigation and larger demand letters for property owners and managers.

Many claims can be mitigated with a standardized response process. Every property should have clear procedures for escalating incidents, communicating with residents, coordinating vendors, and documenting every action taken. Maintenance requests, inspection reports, photos, emails, and repair timelines should all be preserved. Months later, documentation will be your strongest defense.

Communication is equally critical. Residents expect timely updates and clear expectations, especially during water losses, mold concerns, or other habitability issues. Consistent communication not only builds trust but can also reduce the likelihood of disputes escalating into legal claims.

Finally, not every complaint or demand letter should automatically become an insurance claim. Property managers should work closely with legal counsel and their insurance advisor to evaluate the situation, determine whether to place the carrier on notice, and develop the most effective response strategy. A thoughtful approach helps protect both the immediate claim and the long-term health of your insurance program.

The takeaway is simple: the first 48 hours matter. Organizations that respond quickly, communicate consistently, and document thoroughly are far better positioned to reduce litigation and protect their portfolios for the long-term.
